A. It's the action of asking a higher court to reverse a decision of a trial court after a judgment or legal ruling has been rendered.
Q. Can my attorney submit new evidence with an appeal?
A. No, they cannot. You do not submit new evidence with an appeal. An appeal is strictly a legal argument.
Q. Where are state appeals cases heard?
A. For state appeals cases, they are heard in the Supreme Courts. In Maryland and New York the Supreme Courts are called Courts of Appeal.
Q. What types of outcomes can occur in an appeal?
A. There can be a variety of outcomes. The original ruling may be sustained, it may be reversed, sent back to trial court, or it may be reversed or confirmed in part.
